Terms of Use & Service Agreement

PLEASE READ THESE TERMS CAREFULLY. THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

1. The Contractual Relationship

1.1 Acceptance of Terms. By accessing or using the platform located at Emeetconfex.com (the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Emeetconfex.com (“Company”).

1.2 Modifications. Company reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

2. User Obligations and Account Security

2.1 Registration. To access the virtual event platform, you must complete the registration process. You represent and warrant that all information provided is current, complete, and accurate. Failure to provide accurate data constitutes a breach of the Terms, which may result in immediate termination of your account.

2.2 Confidentiality. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Code of Conduct and Acceptable Use

Emeetconfex is dedicated to providing a harassment-free experience for everyone. We do not tolerate harassment of participants in any form.

3.1 Prohibited Conduct. You agree not to:

Engage in any form of bullying, intimidation, or harassment based on gender, race, sexual orientation, disability, or religion.
Use the platform to distribute “spam,” unsolicited commercial links, or promotional materials without express written authorization.
Impersonate any person or entity, including Company employees or other event participants.
Upload or transmit any viruses, worms, or malicious code designed to interrupt or destroy the functionality of the platform.
Use expletives, hate speech, or defamatory language in chat rooms, Q&A sessions, or networking lounges.

3.2 Enforcement. Company reserves the right to monitor all user-generated content and to remove any participant from a virtual event, without refund or warning, if their conduct is deemed detrimental to the professional environment of the conference.

4. Financial Terms: Payment and Cancellation

4.1 Fees. All registration fees must be paid in full via our approved third-party payment processors prior to the start of the event. Discounts cannot be combined or applied retroactively.

4.2 Detailed Cancellation and Refund Policy. Eligibility for a refund is strictly determined by the date of your written cancellation request:

5. Intellectual Property Rights

5.1 Platform Ownership. All rights, title, and interest in and to the Services (excluding content provided by users or speakers) are and will remain the exclusive property of Emeetconfex and its licensors.

5.2 Speaker and Content License. By participating as a speaker or contributor, you grant Company a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display your presentation, likeness, and audio/video recordings for the purposes of the event and subsequent marketing.

5.3 Prohibition of Reproduction. Attendees are strictly prohibited from recording, screen-capturing, or downloading session content or chat logs without the express written permission of Emeetconfex and the respective content owner.

6. Limitation of Liability and Disclaimers

6.1 “As-Is” Service. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Company makes no warranties, express or implied, regarding the platform’s continuous functionality or its fitness for a particular purpose.

6.2 Cap on Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY’S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO ACCESS THE SPECIFIC VIRTUAL EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

7. Force Majeure

Company shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. For a virtual platform, this specifically includes catastrophic failure of internet backbones or third-party cloud hosting services (e.g., AWS/Google Cloud).

8. Governing Law and Dispute Resolution

8.1 Governing Law. These Terms shall be governed and construed in accordance with the laws of Haryana, India, without regard to its conflict of law provisions.

8.2 Binding Arbitration. Any dispute arising out of or relating to these Terms shall be settled exclusively by binding arbitration in Haryana, India. The arbitrator’s decision shall be final and binding on all parties.
